1. Acceptance of Terms
Welcome to ClaimMore (the "Service"), operated by UN8tech Pty Ltd (ABN: 38 691 379 530, ACN: 691 379 530) ("we", "us", "our"). By accessing or using our Service, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use the Service.
These Terms form a legally binding agreement between you and UN8tech Pty Ltd. We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
2. Description of Service
What ClaimMore Is:
ClaimMore is an educational information tool that provides general guidance on Australian tax deductions based on publicly available Australian Taxation Office (ATO) information. The Service uses artificial intelligence technology, specifically a Retrieval-Augmented Generation (RAG) system with Large Language Models (LLMs), to process and present ATO information in an accessible format.
What ClaimMore Is NOT:
- NOT professional tax advice: We are not registered tax agents or BAS agents
- NOT a substitute for qualified tax professionals: You must consult registered tax agents for personal tax advice
- NOT affiliated with the ATO: We are an independent service with no connection to the Australian Taxation Office
- NOT a guarantee of deduction approval: The ATO makes final decisions on all deduction claims
The Service displays information only. It may summarise, transform, or interpret public ATO data for your convenience, but does not constitute professional advice of any kind.
3. Eligibility and User Obligations
Age Requirement:
You must be at least 18 years old to use the Service. If you are under 18, you may only use the Service with the consent and supervision of a parent or guardian who agrees to these Terms on your behalf.
Your Obligations:
By using the Service, you agree and acknowledge that:
- You will NOT rely solely on the Service for any tax decisions
- You will verify all information with the official ATO website (ato.gov.au) or a registered tax agent
- You will consult a registered tax agent for complex tax situations, high-value deductions, or ATO audits
- You are solely responsible for all tax decisions and their consequences
- You will maintain the confidentiality of your account credentials
- You will use the Service only for lawful purposes
4. Prohibited Uses
You must NOT:
- Use the Service to provide tax advice to third parties
- Resell, redistribute, or commercially exploit the Service or its content
- Attempt to reverse engineer, decompile, or extract the source code of the Service
- Use automated systems, bots, or scrapers to access the Service without our prior written consent
- Transmit any viruses, malware, or harmful code
- Violate any applicable laws or regulations
- Interfere with or disrupt the Service or servers
- Impersonate the ATO or claim affiliation with government agencies
- Use the Service in any way that could damage our reputation or business
5. AI Technology and Content Disclaimer
The Service uses artificial intelligence technology, including Large Language Models (LLMs) and Retrieval-Augmented Generation (RAG), to process and present information. You acknowledge and agree that:
- AI-generated content may contain errors, inaccuracies, or outdated information
- AI may misinterpret complex tax rules or provide incomplete analysis
- AI may not account for recent ATO rulings or legislation changes
- AI-generated responses are not tailored to your specific financial circumstances
- We provide NO guarantees regarding the accuracy, completeness, or currency of AI-generated content
You agree not to rely solely on the Service for any tax, legal, financial, or business decisions.
6. No Reliance and Professional Advice Requirement
To the maximum extent permitted by law, you acknowledge and agree that:
- The Service is provided for informational and educational purposes only
- The information displayed does NOT constitute professional tax, legal, or financial advice
- You must independently verify all information with the ATO or qualified professionals
- You should consult with a registered tax agent (find one at tpb.gov.au) before making tax decisions
- We are NOT responsible for any decisions, actions, or consequences arising from your use of the Service
- For complex tax situations, high-value deductions, or ATO audits, you MUST consult a registered tax professional
7. Account Terms and Subscriptions
Free Accounts:
Free accounts provide limited access to the Service. We reserve the right to modify free account features at any time without notice.
Pro/Paid Subscriptions:
Paid subscriptions are billed according to the pricing plan you select. Subscriptions automatically renew unless cancelled. You may cancel your subscription at any time through your account settings.
Refund Policy:
We offer a 14-day satisfaction guarantee for paid subscriptions. If you are not satisfied with the Service within 14 days of purchase, contact us for a full refund. Refund requests after 14 days will be considered on a case-by-case basis.
Termination:
We reserve the right to suspend or terminate your account at any time, with or without cause or notice, if we believe you have violated these Terms. You may terminate your account at any time by contacting us or using account deletion features, if available.
8. Intellectual Property
All intellectual property rights in the Service, including but not limited to text, graphics, logos, software, and the overall design, are owned by UN8tech Pty Ltd or our licensors.
ATO Information: Australian Taxation Office information remains Crown copyright. We use ATO information under fair dealing provisions for research and study purposes. We do not claim ownership of ATO content.
The Service is protected by copyright, trademark, and other laws of Australia and international copyright laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any part of the Service without our prior written permission.
User Data: You retain ownership of any content you submit to the Service. However, by submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process your content for the purpose of providing and improving the Service. We will not use your queries or data to train AI models without your explicit consent.
9. Limitation of Liability
To the maximum extent permitted by the Australian Consumer Law and other applicable laws:
- The Service is provided "as is" and "as available" without warranties of any kind, either express or implied
- We do not warrant that the Service will be uninterrupted, secure, or error-free
- We do not warrant the accuracy, completeness, currency, or reliability of any information displayed
- Our liability for any claim arising from your use of the Service is limited to the amount you paid us in the 12 months preceding the claim, or AUD $100, whichever is greater
- We are NOT liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities
Specific Exclusions:
We are NOT liable for:
- Tax penalties or interest charges imposed by the ATO
- Rejected deduction claims or ATO disputes
- Lost tax refunds or financial losses
- Incorrect deductions claimed based on our Service
- ATO audits or compliance issues
- Decisions made based on information from our Service
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee or right under the Australian Consumer Law that cannot be excluded, restricted, or modified. If any guarantee applies, our liability is limited to repairing or replacing the Service or refunding the amount you paid.
10. Indemnity
You agree to indemnify, defend, and hold harmless un8tech Pty Ltd, its directors, officers, employees, and agents from and against any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses (including legal fees) arising out of or relating to:
- Your use or misuse of the Service
- Your violation of these Terms
- Your violation of any law or regulation
- Your reliance on information displayed by the Service
- Any tax decisions, actions, or consequences resulting from your use of the Service
- Any tax penalties, interest, or ATO disputes arising from your use of the Service
11. Force Majeure
We are not liable for any failure or delay in performance under these Terms which is due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, strikes, government actions, internet failures, or third-party service provider failures.
12. Data Retention
We retain your account data and query history according to our Privacy Policy. Query history is retained for 12 months for free users and 24 months for Pro users. Account data is retained until you request deletion, plus a 90-day backup period. Financial records are retained for 7 years as required by ATO regulations.
Upon account closure, we will delete or anonymize your personal information, except where we are required to retain it by law or for legitimate business purposes.
13. Dispute Resolution
These Terms are governed by the laws of New South Wales, Australia, and the laws of the Commonwealth of Australia. Any dispute arising out of or relating to these Terms or the Service will first be subject to good faith negotiation between the parties.
If a dispute cannot be resolved through negotiation, it will be subject to mediation before a mediator agreed upon by both parties. If mediation is unsuccessful, the dispute will be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
We comply with the Australian Consumer Law and ACCC guidelines. If you have a complaint, please contact us first. You may also contact the ACCC or your state's consumer protection agency.
